These Terms of Use ("Terms") govern your access to and use of landdev.us and the LandDev platform (the "Service"), operated by LandDev, LLC, a Colorado limited liability company ("LandDev," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a firm, company, or agency, you represent that you have authority to bind that organization to these Terms.
LandDev is a project management platform that connects civil engineering firms, land developers, and reviewing jurisdictions on shared land development projects — including project tracking, submittal status, proposals, contracts, and team coordination tools.
LandDev is currently offered as a public beta. This means the Service is provided on an "as is" and "as available" basis, without warranty of any kind. Features may be added, changed, or removed, and the Service may experience downtime, bugs, or data issues during this period. Beta participants who sign up during this period will have their pricing locked in for 2 years from their signup date, as described in our beta agreement presented at signup.
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account. The Service is intended for business use by professionals in the land development industry and is not intended for use by anyone under 18.
Certain account types (engineering firms and developers) are subject to a subscription fee, and jurisdiction accounts are billed per-submittal after an included allotment, as described on our Pricing page. Fees are billed in advance on a recurring basis unless otherwise stated. You may cancel at any time; cancellation takes effect at the end of the current billing period. Beta pricing locked in at signup will not increase for 2 years from the account's signup date, subject to the terms of the beta agreement.
You agree not to:
You retain ownership of the project data, documents, and other content you submit to the Service ("your content"). By submitting content, you grant LandDev a limited license to host, store, and display that content as necessary to operate the Service and to share it with the other parties you invite onto a shared project, consistent with each party's role-based permissions. We do not claim ownership of your content and will not use it for purposes outside operating and improving the Service.
The Service, including its design, software, branding, and underlying technology, is owned by LandDev and protected by applicable intellectual property laws. These Terms do not grant you any right to use LandDev's name, logo, or trademarks without prior written consent.
The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. LandDev does not warrant that the Service will be uninterrupted, error-free, or secure. LandDev is a coordination and communication tool — it does not substitute for professional engineering judgment, jurisdictional review requirements, or independent verification of project compliance.
To the fullest extent permitted by law, LandDev will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business arising from your use of the Service. LandDev's total liability for any claim arising from these Terms or the Service will not exceed the amount you paid to LandDev in the twelve months preceding the claim.
You may stop using the Service and close your account at any time. We may suspend or terminate accounts that violate these Terms, pose a security risk, or engage in fraudulent or abusive behavior. Upon termination, your right to use the Service ends, though certain provisions of these Terms (such as intellectual property, disclaimers, and limitation of liability) will survive.
We may update these Terms as the Service evolves. We will update the "Last updated" date above when changes are made and will provide notice of material changes to active account holders. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
